Acceptance of Terms
These Terms of Service (“Terms”) govern your use of the CaterCamp website at catercamp.com and the CaterCamp platform (the “Service”), operated by CaterCamp (“we,” “our,” or “us”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Description of Service
CaterCamp is a cloud-based catering business management platform that provides CRM, event management, menu building, BEO generation, proposal and contract creation, staff scheduling, equipment tracking, dietary management, invoicing, and client portal features for catering businesses and personal chefs.
Account Registration
- You must provide accurate, complete, and current information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must be at least 18 years old to use the Service.
- You must notify us immediately of any unauthorized use of your account.
Free Trial
We offer a 14-day free trial with full access to all features. No credit card is required to start a trial. At the end of the trial period, you may choose to subscribe to a paid plan. If you do not subscribe, your access to paid features will be suspended, but your data will be retained for 90 days so you can reactivate at any time.
Subscriptions and Payment
- Paid plans are billed on a monthly or annual basis, depending on the plan you choose.
- All fees are charged in advance and are non-refundable, except as expressly stated in these Terms or required by law.
- We reserve the right to change pricing with 30 days’ written notice. Price changes will take effect at the start of your next billing cycle.
- If payment fails, we will notify you and provide a grace period before suspending access.
Your Data
You retain full ownership of all data you enter into the Service, including client records, events, menus, proposals, invoices, and any other business data (“Your Data”).
- We will not access, use, or share Your Data except as necessary to provide the Service, comply with the law, or as described in our Privacy Policy.
- You may export Your Data at any time using the export features in the platform.
- Upon account termination, we will retain Your Data for 90 days, after which it will be permanently deleted unless required by law.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Attempt to gain unauthorized access to any part of the Service or other users’ accounts.
- Upload or transmit viruses, malware, or other harmful code.
- Use the Service to send unsolicited communications (spam).
- Reverse engineer, decompile, or disassemble any part of the Service.
- Resell, sublicense, or provide the Service to third parties without our written consent.
Intellectual Property
The Service, including its design, code, features, documentation, and branding, is owned by CaterCamp and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.
You grant us a limited license to use Your Data solely to provide and improve the Service. This license ends when you delete Your Data or close your account.
Availability and Support
- We aim to maintain 99.9% uptime but do not guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance.
- Support is available via email. Response times depend on your plan tier.
- We may update, modify, or discontinue features of the Service at any time. We will provide reasonable notice for material changes.
Termination
- You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.
- We may suspend or terminate your account if you violate these Terms, with notice where practicable.
- Upon termination, your right to use the Service ceases immediately. Your Data will be retained for 90 days, then permanently deleted.
Limitation of Liability
To the maximum extent permitted by law, CaterCamp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Indemnification
You agree to indemnify and hold harmless CaterCamp and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.
Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
